The Performing Right Society(PRS) (PRSforMusic) TV administration rates return to previous level following the end of the ITV Copyright Tribunal The High Court recently ruled in PRS’ favour following an appeal by ITV against the decision reached by the Copyright Tribunal in June 2016. PRS announce that they are pleased with the outcome and that they believe the new terms of the licence deliver fair value to PRS members.

In August 2015, after careful consideration, the Executive Board approved a temporary increase of one percent to TV broadcast admin rates. This was implemented to cover the expected tribunal costs. Following the successful result, PRSforMusic are reducing PRS TV admin rates back to their original level as shown in the table below:

What does this mean for you?
If you are due TV broadcast earnings from the April distribution onwards, the original rates above will be applied to your royalties. The April 2017 distribution will reflect these reduced rates.

What does this mean for you as a PRS member or are published by a PRS member or published by a PRS member as a non society PRS member? If you are due TV broadcast earnings from the April 2017 distribution onwards, the original rates above will be applied to your royalties. PRS members (songwriters, composers, music publishers) who have earned and/or will go on to earn royalties from ITV during the new deal period (1 January 2014 to 31 December 2017) will be paid according to the new terms agreed with ITV.

Since the Tribunal began, PRS have paid ITV royalties under the terms of the previous deal. This was to ensure that if PRS lost the tribunal they then didn’t have to debit members for overpaid royalties. Following the landmark ruling, the new increased fee will be backdated to January 2014. For usage which has already been distributed PRS will make a top-up payment to reflect the backdated increase, which they aim to distribute in July 2017. The new licence includes all of ITV’s television channels and on-demand services available to viewers in the UK.
